Tell The Florida Legislature To Stop Undermining Our Courts

Republican leaders in the Florida Legislature have set their sights on attacking the independence of Florida’s courts. HJR 121 would put a constitutional amendment on the 2018 ballot that, if passed, would allow the Florida Legislature to override state court decisions they don’t like with a two-thirds vote. It doesn’t take a degree in civics to understand how this undermines our democracy.

We the undersigned urge you to vote No on HJR 121, which represents a direct assault on Florida's courts, separation of powers, and our democracy. Overturning the decisions of our state courts by a two-thirds vote is little more than a naked power grab.

Instead of trying to reinstate laws declared unconstitutional by state courts, the Florida Legislature should be focusing on the real issues facing the judiciary: the undue influence of big money and the lack of diversity on the bench.

    For nearly two decades, the Florida Legislature, Governor, and Cabinet have been under one party control. One of the few checks on their power and extremist excesses has been Florida’s courts, rightly declaring unconstitutional schemes to undermine women’s health, fair districts, public education, and more. Now, Republicans are looking to create a way to neutralize the check provided by our courts once and for all.

HJR 121 would put a constitutional amendment on the 2018 ballot that, if passed, would allow the Florida Legislature to override state court decisions they don’t like with a two-thirds vote. It doesn’t take more than a basic understanding of civics to understand how this undermines our democracy.

    This isn’t the first time we’ve had to fight back against a legislative assault on judicial independence. In 2011, when Republicans enjoyed a two-thirds majority in the legislature, then House Speaker Dean Cannon put a similar amendment on the 2012 ballot. Thankfully, Floridians defeated it by a 2-1 margin.

    Republican leaders in the legislature need to stop trying to turn Florida’s courts into their rubber stamp.
